1. Scope
These Terms & Conditions govern the use of this website, operated by ApexWorks Construction & Waterproofing S.L., and the general framework under which ApexWorks provides quotes and construction, roofing, paving, sealing and epoxy flooring services. Specific project terms are set out separately in each individual written quote or contract.
2. Quotes and pricing
Quotes provided by ApexWorks, whether via this website, phone or in person, are valid for the period stated on the quote document, typically 30 days unless otherwise specified. Prices are based on the scope described at the time of inspection; work outside that scope may require a revised quote, which will always be agreed with the client in writing before proceeding.
3. Booking and deposits
Where a deposit is required to schedule a project, this will be clearly stated in the quote along with what the deposit covers. Deposits are applied toward the total project cost and are not an additional charge.
4. Project execution
ApexWorks will carry out agreed work with reasonable skill and care, in accordance with applicable Spanish building regulations and industry standards. Estimated timelines are provided in good faith; where delays occur due to weather, site conditions or third parties, the client will be informed promptly along with a revised timeline.
5. Guarantees
Workmanship guarantees are provided in writing for each project and specify their duration and scope. These guarantees are in addition to, and do not affect, the statutory rights available to consumers under Spanish and EU consumer protection law, including applicable rules on liability for building defects (Ley de Ordenación de la Edificación, where relevant to the type of work performed).
6. Cancellations
Cancellation terms, including any applicable notice period or cost for materials already ordered, will be set out in the individual project quote. Consumers engaging services at a distance may have additional withdrawal rights under Spanish consumer protection law, which will be respected where applicable.
7. Limitation of liability
Except as required by mandatory law, ApexWorks' liability is limited to the value of the relevant project. ApexWorks is not liable for indirect or consequential losses arising from delays outside its reasonable control.
8. Governing law
These Terms & Conditions are governed by Spanish law. Any disputes will be subject to the courts of the jurisdiction corresponding to ApexWorks' registered address, without prejudice to any mandatory consumer jurisdiction rules.
